Service Agreement

Thank you for your interest in Fischer Funds

  1. What organizations may participate?
    • Nonprofit organizations are local, organizations that have IRS 501(c)(3) status. Fischer Hardware considers organizations such as choirs, youth groups, athletic teams and PTA/PTO/PTSAs that are under the umbrella of the participating school or religious organization to be covered by that sponsoring organization’s 501C status. As long as the sponsoring organization is qualified, subgroups can enroll and receive their own rewards checks.

  2. What the service agreement covers.
    • This is a service agreement between your organization and VA Tools & Home Hardware Inc., DBA Fischer Hardware. You will see us reference VA Tools & Home Hardware Inc. as Fischer Hardware, we, us or our.

  3. When will funds be made available to the organization?
    • All receipts must be turned into the Funds Director no later than the 1st of December. Once all the receipts are verified by the director a check will be cut to your organization no later than December 31st.

  4. How you may use the service.
    • When agreeing to Fischer Funds you will:
      1. Always obey the law
      2. Notify us of any discrepancies or changes
      3. Keep all members of your organization in accordance with the agreement and it’s policy
      4. Print and promote any advertisements
      5. Only purchases made in person at Fischer Hardware qualify for funds.
        1. Online purchases are excluded as well as any purchases made with gift cards or store credit.
        2. Purchases made with cash, check, Visa, Master card, Discover or American express are valid
    • You may not:
      1. Engage in, facilitate or further necessitate unlawful conduct
      2. Use the service in a way that could harm us or our advertisers, affiliates, distributors, vendors or customers.
      3. Use unauthorized receipts from outside sources, returned merchandise, duplicate invoices, falsified documentation, etc.
      4. Damage, photocopy, reprint or duplicate receipts

  5. You are responsible for your account
    • Only the persons in your organization shall submit receipts
    • The coordinator shall deal with the director only
    • All discrepancies must be addressed immediately

  6. Updates to your account
    • Your account history will be available online for the coordinators viewing or anyone they deem responsible
    • The director will update the account quarterly

  7. Refund Policy
    • We allow refunds to be made within a 60 day period with receipt; your members shall take this into consideration when turning in receipts to the organization coordinator.

  8. Online Account Errors
    • We will provide your organization online account updates and funds that you may print or request a copy of quarterly. We are human and may make an error, just notify the director and we will get it fixed as quickly as possible.
    • If an error is found please notify us immediately

  9. Canceling Fischer Funds
    • Once your organization is no longer a non-profit organization you must notify us immediately
    • Cancellation made during the fiscal year will not be paid

  10. Payments to your organization
    • The right to any payment due under Fischer Funds is conditioned upon your organization providing us with all current information required to properly make the payment.
    • You must comply with all conditions stated herein
    • If you receive payment that was in error, we reserve the right to seek return of the payment and you must agree to cooperate with our efforts

  11. Privacy
    • In order for us to enroll your organization we collect certain data. We use and protect that information from any outside sources. *See privacy policy for more information

  12. Agreement Changes
    • If we change this agreement we will notify you at least 30 days prior to the changes taking place. If you do not agree with the changes, then you have the right to cancel the Fischer Funds Agreement. If you agree to the new terms of the agreement then use will continue under the new agreement.

  13. Cancellation or Suspension
    • We may cancel or suspend Fischer Funds at any time for any given reason without cause/ or without notice. Upon cancellation or suspension your right to funds stops immediately.

  14. Interpreting the Agreement
    • All parts of this agreement will apply to the maximum extent of the law. A court may hold that we can not enforce a part of this agreement as written. In this event, then the organization and we will replace the terms that match the content as closely as possible. The remainder of the agreement will not change. This agreement regarding you and us will relate to the Fischer Fund donations made on behalf of VA Tools & Home Hardware Inc. This agreement supersedes any prior obligation and will remain in force.

  15. Assignment
    • You may not assign this agreement or any part of it to any other organization, party or person. Checks will only be made payable to the non-profit organization that agreed to the terms.

  16. No Third Party Beneficiaries
    • This agreement is solely for your and our benefit. It is not for the benefit of any other organization/person/party

  17. Web Site
    • We promise to send you important information in connection with the agreement and have the right to send you additional information including but not limited to advertising, specials, coupons, etc. We ask you print these advertisements for your organization and post them in or at your community board. These advertisement are for the benefit of the organization only and do not have to be used.
